TERMS OF SERVICE
Last updated: September 2026
OVERVIEW
Welcome to Kid ’N Play Store.
These Terms of Service (“Terms”) apply to your use of our website, online store, products and related services.
Throughout these Terms, “we”, “us” and “our” refer to KID N PLAY STORE LIMITED, trading as Kid ’N Play Store.
Our online store is powered by Shopify, which provides the ecommerce platform that allows us to sell our products and services to you.
By accessing our website, browsing our store or placing an order, you agree to these Terms together with our Privacy Policy, Refund Policy and any other policies referred to on our website.
Please read these Terms carefully before using our website or purchasing from us.
Nothing in these Terms excludes or limits any statutory consumer rights that cannot legally be excluded or limited.
1. USING OUR WEBSITE
You may use our website only for lawful purposes.
By placing an order with us, you confirm that:
- you are legally capable of entering into a binding contract;
- the information you provide to us is accurate and complete;
- you are authorised to use the payment method provided; and
- your purchase is for legitimate personal or household use unless otherwise agreed with us.
If you create an account, you are responsible for keeping your login information secure and for activity carried out through your account.
You must not misuse our website, attempt to gain unauthorised access to it or interfere with its security or operation.
2. OUR PRODUCTS
We make reasonable efforts to display our products accurately.
However, colours and appearance may vary slightly depending on your screen, device settings, lighting and other factors.
Product photographs, mock-ups and lifestyle images are intended to represent the design and general appearance of our products. Minor differences in print positioning, colour, sizing or finish may occur as part of the manufacturing process.
Product descriptions, specifications, designs, availability and pricing may be updated from time to time.
We reserve the right to discontinue products or limit quantities where reasonably necessary.
Nothing in this section affects your statutory rights, including your right to receive goods that are as described, of satisfactory quality and fit for their intended purpose.
3. SIZING
Customers are responsible for selecting the appropriate garment size when placing an order.
Where available, sizing information or size guides are provided to help customers select the correct size.
Actual garment measurements may vary slightly because of normal manufacturing tolerances.
Please check the available sizing information carefully before ordering.
Your statutory rights are not affected where an item is faulty, incorrectly supplied or materially different from its description.
4. ORDERS
When you place an order, you are making an offer to purchase products from us.
Receipt of an order confirmation does not necessarily mean that your order has been accepted.
Your order is accepted when we confirm acceptance or begin processing or producing the order.
We reserve the right to refuse or cancel an order where reasonably necessary, including where:
- a product is unavailable;
- there is an obvious pricing or product-description error;
- payment cannot be authorised;
- we reasonably suspect fraudulent activity;
- shipping restrictions prevent us from fulfilling the order; or
- circumstances outside our reasonable control make fulfilment impossible.
If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled item or order.
Please check your order carefully before submitting it.
If you need to request a change or cancellation, contact us as soon as possible. We cannot guarantee that changes can be made once production or fulfilment has started.
Any statutory cancellation rights you have remain unaffected.
5. MADE-TO-ORDER PRODUCTS
Some of our garments are produced or printed after an order is placed.
Where a product is described as “produced to order” or “made to order”, this means production may begin after your purchase has been confirmed.
Estimated production times shown on product pages are separate from delivery times.
A standard product being manufactured or printed after an order is received does not automatically remove any statutory cancellation or return rights you may have.
Where a product is genuinely personalised or produced to your individual specification, different cancellation rules may apply where permitted by law.
Please refer to our Refund Policy for further information.
6. PRICES
Prices displayed on our website may vary according to the customer's selected country, region or currency.
The price applicable to your order is the price displayed when your order is placed, subject to correction of obvious errors.
Shipping charges and any applicable taxes or duties will be displayed where applicable during the purchasing process.
Prices, promotions and discount offers may change without notice.
Promotional prices do not create an entitlement to a refund of the difference for orders placed before or after the promotional period unless we expressly state otherwise.
7. PAYMENT
Payment must be made using one of the payment methods made available during checkout.
You confirm that you are authorised to use the payment method supplied.
Orders may be subject to payment verification and fraud-prevention checks.
If payment is declined or cannot be authorised, we are not obliged to fulfil the order.
Payments may be processed by Shopify Payments or other third-party payment providers.
Those providers may process information in accordance with their own applicable terms and privacy policies.
8. PRODUCTION
Some products are produced on demand.
Production estimates shown on our website are estimates and may vary during particularly busy periods, product launches, promotional events and holiday periods.
Production time is not the same as shipping time.
Where possible, we will provide customers with updated information if there is a significant unexpected delay affecting their order.
9. SHIPPING AND DELIVERY
We deliver to the destinations displayed as available during checkout.
Estimated shipping and delivery times are provided as guidance unless we expressly state that a particular delivery date is guaranteed.
Delivery may occasionally be affected by circumstances outside our reasonable control, including carrier delays, customs processing, adverse weather, industrial action or unusually high seasonal demand.
Where tracking is available, tracking information will normally be provided once the order has been dispatched.
We will remain responsible for fulfilling our obligations to you in accordance with applicable consumer law.
Nothing in these Terms transfers responsibility for goods to you earlier than permitted by applicable law.
For UK consumers, where no different delivery time has been agreed, applicable consumer rules generally require goods to be delivered within the legally prescribed period.
10. INTERNATIONAL ORDERS
Customers ordering outside the country from which their order is fulfilled may be responsible for customs duties, import taxes or other charges imposed by the destination country unless these charges are expressly included at checkout.
Customs procedures may cause delays that are outside our reasonable control.
Customers are responsible for ensuring that products ordered can legally be imported into their destination country.
Where different mandatory consumer protections apply in the customer's country of residence, nothing in these Terms is intended to remove rights that cannot legally be excluded.
11. RETURNS, CANCELLATIONS AND REFUNDS
Returns, cancellations and refunds are handled in accordance with our Refund Policy and applicable consumer law.
For eligible UK distance purchases, consumers generally have the right to notify us that they wish to cancel within 14 days after receiving their goods, without needing to provide a reason.
Following notification of cancellation, the customer will normally have a further 14 days to return the relevant goods, subject to any lawful exceptions.
Certain categories of goods may be exempt from cancellation rights, including genuinely personalised or custom-made products where the legal exemption applies.
The customer may inspect and try on garments in the same way they reasonably would in a physical shop. We may be entitled to make an appropriate deduction where goods have been handled beyond what is reasonably necessary to establish their nature, characteristics and functioning.
Faulty, damaged, incorrectly supplied or misdescribed products are dealt with separately in accordance with applicable consumer law.
Please read our Refund Policy for full instructions before returning an item.
Nothing in our Refund Policy or these Terms affects statutory rights that cannot legally be excluded.
12. FAULTY OR INCORRECT GOODS
If you receive an item that is faulty, damaged, incorrect or materially different from its description, please contact us as soon as reasonably possible.
Please provide your order information and, where appropriate, photographs showing the issue so that we can investigate.
Our obligations relating to faulty or misdescribed goods are governed by applicable consumer law.
Nothing in these Terms restricts rights customers may have to repair, replacement, refund, price reduction or other remedies where those rights apply.
13. INTELLECTUAL PROPERTY
Unless otherwise stated, the content available through our website, including text, graphics, artwork, product imagery, logos, branding, layouts, photographs, videos and other content, is owned by us or used by us with permission from the relevant rights holder.
Kid ’N Play names, imagery, branding and associated intellectual property may belong to or be used with the permission of the relevant owners or licensors.
The Legacy Club branding, artwork and associated material may also be protected by intellectual property rights.
You may use our website for personal, non-commercial purposes only.
You must not reproduce, modify, distribute, commercially exploit, publish or otherwise use protected material from our website without the permission of the relevant rights holder.
Third-party trademarks and intellectual property remain the property of their respective owners.
14. REVIEWS, PHOTOGRAPHS AND USER CONTENT
If you voluntarily submit a review, photograph, video, testimonial, social-media content or other material to us for promotional use, you confirm that you have the right to provide that material.
Where you give us permission to repost or use submitted content, you grant us a non-exclusive, royalty-free licence to reproduce and display that content for reasonable marketing and promotional purposes.
We will not knowingly claim ownership of your original content merely because you provide it to us.
Where reasonably possible, you may contact us if you would like us to stop using future reproductions of content you previously permitted us to use.
You must not submit content that infringes another person's intellectual property, privacy or other legal rights.
15. THIRD-PARTY LINKS AND SERVICES
Our website may contain links to websites, social-media platforms or services operated by third parties.
We do not control third-party websites and are not responsible for their content, availability, products, security or privacy practices.
Visiting a third-party website is at your own discretion and may be subject to that third party's terms and policies.
16. SHOPIFY
Our online store is hosted and powered by Shopify.
Shopify provides the ecommerce technology used to operate the store, but purchases made through our website are made between you and KID N PLAY STORE LIMITED trading as Kid ’N Play Store, not between you and Shopify.
Shopify and associated service providers may process information relating to your use of our website and transactions in accordance with applicable privacy requirements and their own policies.
Please see our Privacy Policy for further information.
17. PRIVACY
We take the handling of personal information seriously.
Information collected through our website is processed in accordance with our Privacy Policy and applicable data-protection legislation.
Because our store is hosted by Shopify, certain information may also be processed by Shopify and approved service providers for purposes including hosting, payments, fraud prevention, order processing and ecommerce functionality.
Please review our Privacy Policy for more information about how personal information is collected, used and protected.
18. EMAIL AND MARKETING COMMUNICATIONS
Where you choose to subscribe to marketing communications, we may send you information about new products, releases, offers, events and other relevant updates.
You may unsubscribe from marketing communications at any time by using the unsubscribe facility included in our marketing emails or by contacting us.
Transactional communications relating to an order, payment, delivery, refund or account are separate from marketing communications and may still be sent where reasonably necessary.
19. PROMOTIONS AND DISCOUNT CODES
Promotions, discount codes, Black Friday offers, bundles, competitions and other special offers may be subject to additional conditions.
Unless otherwise stated:
- offers cannot be exchanged for cash;
- discount codes cannot be applied retrospectively;
- multiple discount codes may not be combinable;
- promotions may apply only to selected products;
- promotions may be subject to availability; and
- promotional periods may end at the stated closing time.
We may withdraw or amend a promotion where reasonably necessary, provided this does not unfairly remove rights already acquired by customers who have completed qualifying transactions.
20. ERRORS AND INACCURACIES
We try to ensure that information on our website is accurate.
Occasionally, information may contain typographical errors, pricing errors, product-description errors or availability inaccuracies.
Where an obvious error occurs, we may correct it as soon as reasonably possible.
If an error materially affects an order that has already been placed, we will contact the customer and provide an appropriate option, which may include cancellation and a refund.
We will not use this provision to remove statutory consumer rights or avoid obligations already lawfully owed to customers.
21. PROHIBITED USE
You must not use our website:
- for unlawful or fraudulent purposes;
- to infringe intellectual property rights;
- to transmit malicious software or harmful code;
- to attempt unauthorised access to our systems;
- to collect information about other users unlawfully;
- to impersonate another person or organisation;
- to interfere with the operation or security of our website;
- to send spam or other unauthorised communications; or
- in any way that may cause unlawful harm to us, our customers or third parties.
We may restrict or suspend access where we reasonably believe the website is being misused.
22. OUR RESPONSIBILITY TO YOU
We do not exclude or limit liability where it would be unlawful to do so.
Nothing in these Terms excludes or restricts liability for:
- death or personal injury caused by negligence where such liability cannot legally be excluded;
- fraud or fraudulent misrepresentation;
- faulty or misdescribed goods where statutory rights apply; or
- any other liability or consumer right that cannot lawfully be excluded or restricted.
We are not responsible for losses that were not reasonably foreseeable when the contract was formed or for losses caused solely by circumstances for which we are not legally responsible.
If you are purchasing as a consumer, we supply products for private and domestic use.
Nothing in this section affects your statutory rights.
23. EVENTS OUTSIDE OUR REASONABLE CONTROL
We will not be responsible for a failure or delay in performing obligations where that failure or delay results from events outside our reasonable control.
These may include severe weather, natural disasters, transport disruption, industrial disputes, customs disruption, war, civil disorder, government action, widespread communications failure or other events that we could not reasonably prevent.
If such an event materially affects an order, we will take reasonable steps to minimise the effect and communicate with affected customers where appropriate.
Your statutory cancellation, refund or other consumer rights remain unaffected where applicable.
24. CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect changes to our business, website, products, technology or legal requirements.
The version applicable to an order will normally be the version in effect when that order was placed.
Any updated version will be published on our website together with an updated revision date.
We will not retrospectively change contractual terms in a way that unfairly removes rights already acquired by a customer.
25. SEVERABILITY
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be treated as removed or limited only to the extent necessary.
The remaining provisions will continue to apply.
26. WAIVER
If we do not immediately enforce a right under these Terms, this does not mean that we have waived that right.
A waiver on one occasion does not automatically constitute a waiver on another occasion.
27. GOVERNING LAW
These Terms are governed by the laws of England and Wales.
If you are a consumer living elsewhere, you may also benefit from mandatory consumer protections available under the laws of the country in which you live.
Nothing in these Terms is intended to prevent a consumer from relying on mandatory legal rights or bringing proceedings in a court where applicable consumer law permits them to do so.
28. ENTIRE AGREEMENT
These Terms, together with our Privacy Policy, Refund Policy and any other policies or terms expressly incorporated into them, form the agreement between you and us regarding use of our website and purchases made through it.
Nothing in this section limits rights arising from statements or representations that cannot legally be excluded.
